Welcome to FocusMate! These Terms of Service ("Terms") govern your use of the FocusMate mobile application ("App") and related services provided by FocusMate ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using FocusMate, you confirm that you:

• Are at least 13 years of age (or the minimum age in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

If you are using the App on behalf of a minor (as a parent or guardian), you accept these Terms on their behalf and are responsible for their use of the App.

2. Description of Service

FocusMate is a digital wellness application designed to help users:

• Track physical activity and daily steps
• Manage screen time and app usage
• Build healthier digital habits through gamification
• Connect with friends for wellness challenges
• Discover outdoor spaces and nature locations

3. Account Registration

3.1 Account Creation

To access certain features, you may need to create an account using Sign in with Apple or other authentication methods. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

When using FocusMate, you agree NOT to:

• Use the App for any illegal purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or content
• Impersonate others or misrepresent your identity
• Use automated systems to access the App
• Circumvent any access restrictions or security measures

5. Health and Safety Disclaimer

• The App does not provide medical advice, diagnosis, or treatment
• Consult a healthcare professional before starting any exercise program
• Step counts and activity data are estimates and may not be fully accurate
• Do not rely on the App for medical decisions
• Be aware of your surroundings when walking or exercising outdoors

6. Screen Time Features

FocusMate's app blocking and screen time features are intended as tools to help you build better habits. By using these features, you acknowledge:

• You have chosen to enable these restrictions voluntarily
• The App uses iOS Screen Time APIs with your permission
• Blocking features can be disabled at any time
• We are not responsible for any consequences of app restrictions

7. Subscriptions and Payments

7.1 Premium Features

Some features may require a paid subscription. Subscription details, pricing, and terms are displayed in the App before purchase.

7.2 Billing

• Payments are processed through Apple App Store or Google Play
• Subscriptions auto-renew unless cancelled before the renewal date
• Prices may change with notice provided in advance

7.4 Auto-Renewal & Cancellation

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Your account may be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions in your device’s App Store / Play Store subscription settings.

7.5 One-Time Purchases (if offered)

If we offer a one-time “lifetime” purchase, it is a single charge (non-consumable) that unlocks premium features for the lifetime of the product. “Lifetime” does not guarantee that the Service or specific features will be available indefinitely.

7.3 Refunds

Refund requests are handled by Apple or Google according to their respective policies. Contact their support for refund inquiries.

8. Intellectual Property

All content, features, and functionality of FocusMate, including but not limited to:

• Software code and algorithms
• Visual design and user interface
• Logos, icons, and branding
• Text, graphics, and images

are owned by FocusMate and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. User Content

You retain ownership of content you create (such as profile information or challenge messages). By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute such content within the App's functionality.

10. Third-Party Services

FocusMate may integrate with third-party services including:

• Apple HealthKit for health data
• Apple Screen Time APIs
• Firebase for backend services
• Map services for location features

Your use of these services is subject to their respective terms and privacy policies.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Disclaimer of Warranties

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will be accurate or reliable

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUSMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to your data
• Any third-party conduct or content
• Any content obtained from the App

14. Indemnification

You agree to indemnify and hold harmless FocusMate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable rules.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FocusMate regarding the use of the App.
